Pension Application of John Jones: W372

State of Tennessee}

Claiborn [now spelled Claiborne] County}

This being the 18th day of March 1834.

John Jones aged about 72 years made oath in due form of law before the Court of Pleas and quarter sessions for the said County the same being a Court of Records and makes the following declaration in order to obtain the Benefit of the Act of Congress past the 7th June 1832,

            he states that he entered the service of the United States & served as hereafter mentioned served under the following named officers as follows to wit, he states that he resided in the County Botetot [sic: Botetourt] State of Virginia and there volluntered himself in the services of his Country under Captain Hanley [sic: Alexander Handly] of said County in the month of November 1780, for the term of three months and was marched under the said Captain to the state of North Carolina  Said Captains company was then in said march under Major David Campbell  we then joined General Morgain [sic: Daniel Morgan]  after that, we had a Scrimage with the Brittis and Tories on the Adkin River [sic: at Trading Ford on the Yadkin River near Salisbury NC, 4-5 Feb 1781]  thence we was marched to Halifax Virginia at which place our Major was Discharged and we the soldiers went home and at home I was discharged by Ensign [Joseph] Looney which discharge I have lost or mislaid so that I cannot produce it  in this Term my Time of service was from November untill the month of March the next spring, making in all Five months.

            Then in the month of August 178[last digit missing; should be “1"] I was drafted to serve under Captain David May and entered into service for the Term of three months was marched from same County under said Captain May to York Town Virginia commanded by Col. Samuel Vance  we then was attached to the main army commanded by General Washington  we then was placed gard over prisoners and marched to Winchester Virginia, where we remained a few days and was sent home and after we got home I was discharged by Moses Man an Ensigne  The time of his servis ended about the last of Dec, the same  making this terme of servis being about five months more making my hole term of servis in all Ten months at the end of this Time of servis all hostilletys being at an end  the discharge for this last servis I also lost or mislaid so that I cannot find it. he states that he has no dockeymintry evedence to prove his services nor dose he know of any living evedence by whom he can prove the same. he hereby relinquishes every claim to a pension or annuity except the present and Declares that his name is not on the Pension Role of any agency of any State whate soever

1st       where and in what year was you borne

Answer. I was borne in the year 1762. I was borne in the state of Maryland St. Mary’s County

2nd      have you any record of your age and if so where is it.

Answer. no I have none only as I have been told by my Parents.

3d        where was you liveing when cald into service and where do you now live. and where have you lived seenc the Revolutionary War.

Answer. I lived in Bothetot County in the state of Virginia when cald into sevice  I lived in said County untill I came to the county of Claiborn State of Tennessee where I now live

4th       How was you cald into service  was you drafted was you a vollunteer or was you a substitute if so for whom.

Answer. I vollunterd under Captain Hanley  Next I was drafted under Captain David May

5th       State some of the Regular officers who was with the Troops where you served. Such Continental and [illegible; should be “Militia”] Regiments, as you can recollect and the general engagements, of your service

Answer. I new Col. [William] Washington when in the service  I new Col. [John Eager] Howard  General Morgain and Generall George Washington.

6th       did you ever receive a discharge and if so from whome

            Answer  I Received 2  one from Ensign Main[?] and one from Ensign Man

7th       State the name of some of your Neighbors who can testify to your carickter for verasity and their belief of your services as a soldier of the Revolution  Answer I now John Hunt the Sheriff John Mason—

State of Tennessee}

Claiborn}                      On this fourth day of September one thousand eight hundred and forty three personally appeared before me John Richee a justice of the peace in and for the County and state aforesaid Mary Jones a resident of said County aged sixty nine years who being first duly sworn according to law doth on her oath make the following declaration in order to obtain the benefits of the provision made by the act of Congress passed the 7th of July 1838 entitled an act granting half pay and pensions to certain widows; That she is the widow of John Jones late a pensioner of the war of the revolution a private in the army; She states that she has no knowledge of the nature of his services under whom he served or where the services was performed or the length of time in service or battles he was in if any; as they were all performed before her acquaintance with her said husband but, for the facts of his service the kind of service length of time and battles if any he was in she would refer the department to the testimony on the files of the department on which her said husband was pensioned; he received his certificate of pension about the 28th of September 1834 as well as she recollects, was pensioned at twenty dollars perannum under the act of June 7th 1832 and enrolled on the pension roll at Knoxville in east Tennessee; and was paid there untill his death which took place the 14th of February 1842; some time after his death she made the necessary proof and drew the arrearage of pension that was due her husband on the day of his death; at which time the certificate of pension was surrendered and her receipt by her attorney and other papers filed which she supposes has been returned to the department all of which documents and papers she would refer the department; She would state that she was born and raised in Bath County Virginia her name before her marriage was Mary Fitzpartrick [sic] daughter of James Fitzpartrick and that she was married to the said John Jones Identically the same that was pensioned and referd to above on the fifteenth day of September 1792 as will more fully appear by reference to the accompanying records properly certified by the Clerk of the County Court of Bath Va. under the seal of office; and hereto affixed and as to her Identity she would refer this department to the family record taken from her family bible and a part of the old record from which the last part was transcribed by the direction of her husband some years before his death and accompanying Deposition of John Jones jun’r.  She states that she and her husband settled within three miles of the place she now lives when this State was a territory of North Carolina and has never lived any where else since  She now lives in Claiborne County where they lived at the time her husband was pensioned and most positively avers that she is the Identical Mary Fitzpartrick and her deceased husband John Jones deceased pensioner is the Identical person referd to in the records from Bath County Va. She further declares that she was married to the said John Jones by Christopher Clark a prysbeterian minister on the fifteenth day of September seventeen hundred and ninety two; That her said husband John Jones died on the fourteenth day of February one thousand eight hundred and forty two; That she was not maried to him prior to his leaving the service but the mariage took place previous to the first day of January seventeen hundred and ninety four at the time and place above stated

            Sworn to and subscribed on the day and year first above written before me  She also states that she is still the widow of John Jones deceased pensioner           Mary herXmark Jones
