WILL
OF PAUL EBERHART
Know all men by these presents, that I, Paul
Eberhart of Hickory Township, Mercer County, State of Pennsylvania,
farmer, being in good health and of sound and disposing mind and memory,
do make and publish this my last will and testament, hereby revoking all
wills by me at any time heretofore made.
And as to my worldly state, and all the property, real, personal or
mixed, of which I shall die seized, or possessed, or to which I shall be
entitled at the time of my decease, I devise, bequeath and dispose thereof
in the following manner, to wit:
First, my will is that all my just debts and funeral expenses shall
by my executors hereinafter named be paid out of my estate (personal) as
soon after my decease as shall be found convenient by them.
Secondly, to my beloved wife Sarah, I
bequeath sixty seven acres of land now possessed by me situated in Hickory
Township, Mercer County, Pennsylvania, to be hers during her lifetime:
my son Reuben to have the use or
control of it during that time by paying yearly to my wife the interest of
one thousand dollars or instead of that by supporting her; but should she
prefer living with any other child of hers then the interest of one
thousand dollars is to be paid her yearly by my son Reuben. Further, after the death of my wife this land is to belong to
Reuben by paying one thousand dollars to my
four daughters or their heirs. Also
to my wife I bequeath the annual interest of a promissory note of eight
hundred dollars held against my son Reuben.
Also to my wife all other promissory notes and book accounts I may
then hold. Also to her
whatever personal property may remain after paying my debts and funeral
expenses.
I desire that Reuben shall have one
year after the death of myself and wife in which to pay the one thousand
dollars to the girls without any interest during that year.
Inasmuch as I possess the coal right of the tracks of land now held
by me and that adjoining formerly owned by son Berlin,
I desire that my son Reuben shall have half
the entire interest thereof and the remaining half to be equally divided
among the five remaining children or their heirs.
And lastly, I do nominate my son Reuben
Eberhart and son-in-law Albert Pool to
be the executors of this my last will and testament.
In testimony whereof, I the said Paul
Eberhart, have to this my last will and testament contained on one
sheet of paper subscribed my name and affixed my seal this tenth day of
February in the year of our Lord one thousand eight hundred and sixty
five.
