| Proceedings Dealing with Distribution
of the Estate of Ephraim Goad, deceased in Berryville, Carroll Co., Arkansas1881
- 1884
Contributed by Cynthia Wellman:
I am descended from Ephraim (they spelled it Ephriam) Goad. One
of my ancestor's sons was Judge T.S. Bunch.
A.G. Moore was a son-in-law of Ephraim Goad; I believe the difference
in the total amount of money represents everyone's share, excluding what
is to be paid to his wife for her share of the estate. Old Eph's son, Ephraim
Taylor T. Goad had gone to Oklahoma or Texas earlier, as had other children,
therefore the cause for the length of the proceedings.
Court met at 8 ½ o'clock on Tuesday morning January 18th 1881,
present and presiding the Hon. T.S. Bunch, Judge of the Probate Court when
the following proceedings were had to wit.
On this day was presented to the Court the petition of A.G. Moore administrator
of the Estate of Ephriam Goad deceased representing that there is a small
amount of personal property belonging to said estate that is liable to
go to waste or greatly depreciated in value and being verified by an affidavit
and asking the Court to make an order to see said personal property on
such terms as the Court deems advisable and the Court being fully advised
in the premise. It is therefore ordered by the Court that said Administrator
proceed to sell the said personal property at the premises of the deceased
on Thursday February the 10th 1881 first giving notice as is required by
law on a credit of three months for all sums of Five dollars and more,
on less amounts cash on delivery of property. Purchaser to be required
to give land or note with approved security with interest at ten percent
from date until paid and said Administrator will make a report of said
sale at the next term of this Court.
On this day was presented to the Court the petition of A.G. Moore Administrator
of the Estate of Ephriam Goad deceased representing that the personal property
of said Estate is not sufficient to pay debts of said Estate. Representing
further that there is certain Real Estate belonging to said Estate described
as follows to wit. The W ½ of the SE ¼ of Section 1 in Township
18N of Range 24 West and the W ½ of the NE ¼ of Section 12
in Township 18N of Range 24. And the Court being fully advised in the premise
doth grant the prayer of the said petitioner. It is therefore ordered by
the Court that said Administrator after giving notice as is required by
law proceed on Saturday the 12th day of February 1881 to sell the above
described land at the Court House door in the town of Berryville, Arkansas
to the highest bidder on a credit of six months. Purchaser to give note
with approved security with interest at 10% of sale till paid, provided
that all of said lands bring two thirds of their appraised value and that
said Administrator give the time and terms of sale in his notice and that
he report the same at the next term of this Court.
