An act passed by the Kentucky legislature on February 14, 1866 made it legal for "negroes and mulattos" to have their marriages recognized. Couples paying a fee of 50 cents could have their marriage recorded by their county court clerk, who was to maintain separate registers for blacks and whites. See the Kentucky Historical Society's Legislative Moment, "Former Slaves Marry."

The Freedman's Bureau was established in the U.S. War Department by an act of March 3, 1865 to handle sundry matters relating to refugees and freedmen. Several state and city bureau offices registered declared marriages. Reginald Washington writes that there is a single Kentucky marriage license and certificate contained in the records of the Office of the Freedman's Bureau Commissioner. There are some documents for Kentucky sub-districts, but Lexington is not among them. Two Prologue articles provide helpful background information on this period:
